    WASHINGTON / RankWire.AI / – In a recent statement from Washington, D.C., ethics watchdog groups Democracy Defenders Action and Transparency International U.S. urged Congress to implement stringent anti-corruption measures in the ongoing debate over cryptocurrency legislation or to abandon the CLARITY Act entirely. The nonpartisan organizations criticized the proposed Digital Asset Market Clarity Act, highlighting that its current language leaves significant loopholes. They emphasized that without firm bans on self-dealing by government officials, the legislation fails to protect American consumers, ensure economic stability, or secure the integrity of the crypto market.

    Legal professionals from both groups pointed out that the ethics provisions in the Senate draft are narrowly defined and include major statutory exemptions. The advocacy organizations stated that the draft permits existing cryptocurrency holdings and financial arrangements to remain unchallenged, while lacking effective enforcement mechanisms. They argued that the wording effectively grants immunity to pre-existing digital asset ventures from federal oversight. To promote real reform, the watchdogs called for a total ban preventing all covered government officials from holding direct financial interests, engaging in digital asset trading, or receiving revenue from prior licensing and profit-sharing deals.

    The coalition outlined essential policy measures to prevent public officials from exploiting digital asset regulations for personal financial benefit. The proposed ethics rules require officials and their immediate family members, including spouses and dependent children, to divest from all digital assets except diversified registered investment funds. Additionally, the groups recommended strict restrictions to stop adult children of public officials from using family ties or proximity to power to promote commercial crypto ventures. They also stressed that full financial disclosures should cover all digital asset transactions, including acquisitions, sales, and transfers, regardless of compensation received.

    Senate CLARITY Act Provisions Under Fire for Potential Loopholes

    On enforcement, the oversight groups stated that ethics rules must be supported by independent administrative authority to remain effective beyond a president’s term. They called on Congress to empower the Attorney General with investigatory authority under a longer statute of limitations and to allow private individuals and state attorneys general to pursue legal action against misconduct. Virginia Canter, chief counsel and director of ethics and anti-corruption at Democracy Defenders Action, warned that without independent enforcement, ethics legislation is just a green light for corruption, and urged Congress to impose a total ban on digital asset interests for officials and their families.

    Analysts and policy experts noted that the broader debate surrounding the CLARITY Act focuses on defining regulatory jurisdiction over digital assets. The legislation aims to clarify regulatory authority between federal market regulators, shifting away from enforcement-heavy strategies. However, ethics advocates emphasize that public confidence depends on clear boundaries separating regulatory oversight from private financial interests. Scott Greytak, deputy executive director at Transparency International U.S., noted that the public expects officials to choose between regulating an industry or profiting from it, and urged lawmakers to close crypto conflict of interest loopholes or discard the CLARITY Act altogether to protect government integrity.

    Growing Calls to Remove Grandfathering of Existing Investments During Senate Review

    As the Senate considers the bill, increasing pressure is mounting from ethics organizations for lawmakers to address conflicts-of-interest safeguards. Oversight experts warn that exempting existing commercial relationships could set a dangerous precedent for federal ethics enforcement across emerging financial sectors. Representatives from both groups reiterated that eliminating these exemptions is the minimum needed to restore public trust in federal oversight of markets.

    The fate of the CLARITY Act hinges on whether committee negotiators include binding ethics provisions before the final floor vote. Congressional aides reported ongoing bipartisan talks about possible amendments to enforcement mechanisms. Ethics advocates caution that passing the legislation without comprehensive prohibitions on conflicts of interest risks undermining regulatory credibility and perpetuating integrity issues within the federal government.
